TERMS AND CONDITIONS OF SALE
Article 1 – Definitions
For the purposes of these Terms and Conditions of Sale (TCS), the following definitions apply:
- Customer: any natural person of legal age with legal capacity, or any legal entity, having placed an Order on the Website.
- Order: any request for Products made by the Customer via the Website and confirmed by La Cave du Château, subject to full payment and availability of stock.
- Terms and Conditions: the present TCS governing the use of the Website and the sale of Products.
- My Account: personal space created by the Customer on the Website to manage Orders and information.
- Delivery time: period between the validation of the Order and the actual delivery of the Products to the Customer.
- Delivery costs: costs related to the shipment of Products to the address provided by the Customer.
- Delivery: handing over of Products to the Customer by a carrier or representative mandated by La Cave du Château.
- Price: the amount invoiced for a Product, including or excluding VAT depending on the destination, excluding delivery costs.
- Products: goods or services offered for sale by La Cave du Château on the Website.
- Website: the e-commerce site www.lacaveduchateau.com operated by La Cave du Château.
- User: any person browsing the Website.
- Personal Data: information allowing the direct or indirect identification of a natural person.
Article 2 – Purpose and Scope
These TCS govern:
1. The use of the Website by any User.
2. The contractual relationship between La Cave du Château and the Customer regarding the online sale of Products.
By confirming an Order, the Customer acknowledges having read and accepted these TCS without reservation.
Article 3 – Registration on the Website
3.1. Registration is free and optional. It allows the Customer to access personalized services (order history, multiple addresses, private sales, etc.).
3.2. When creating an account, the Customer chooses a personal and confidential username and password. The Customer is solely responsible for their use.
3.3. The Customer must not share or transfer access to third parties. Any fraudulent use of the account is the sole responsibility of the Customer.
3.4. The Customer must provide accurate information and update it regularly (particularly contact details). Any failure to do so engages their responsibility.
3.5. In the event of non-compliance with the TCS, La Cave du Château may suspend or delete the account, after a formal notice remaining without effect. In case of serious misconduct, deletion may be immediate.
Article 4 – Products
4.1. Each Product is described in detail on its dedicated page, specifying its essential characteristics. These details are contractually binding and accepted by the Customer without reservation.
4.2. Some Products may have different formats. The Customer must check the Product sheet carefully before validating the Order.
4.3. The photos displayed on the Website are for illustration purposes only and are not contractually binding.
4.4. Offers are valid as long as they are visible and available. Adding a Product to the cart does not constitute validation of the Order.
Article 5 – Prices
5.1. Prices are expressed in euros, inclusive of all taxes for sales in France, excluding delivery costs. For deliveries outside the European Union or within the EU with a valid VAT number, prices are exclusive of taxes.
5.2. Orders must be paid exclusively in euros.
5.3. Delivery costs are charged in addition, depending on the method chosen by the Customer.
5.4. Additional duties or taxes may apply in the country of import. They are borne and declared by the Customer.
5.5. La Cave du Château may change its prices at any time. However, billing will be based on the rate in effect at the time of the validated Order.
5.6. Products remain the property of La Cave du Château until full payment is made. The risks transfer to the Customer upon receipt of the Products.
5.7. In the event of a manifest error in price (typographical, calculation, etc.), La Cave du Château may cancel the Order and propose a new one at the correct price.
Article 6 – Orders
6.1. The Customer may order through their account or as a guest.
6.2. To confirm an Order, the Customer must follow the steps indicated on the Website (select Products, provide contact details, choose delivery and payment method, confirm payment).
6.3. No minimum order amount is required.
6.4. Validation of the Order constitutes acceptance of the prices, characteristics of the Products, and these TCS.
6.5. The Customer receives a confirmation email within 24 working hours. This email summarizes the Products, quantities, prices, delivery costs, taxes, and addresses. If no confirmation is received, the Order is not considered accepted.
6.6. In the event of unavailability of a Product, La Cave du Château informs the Customer and proposes a replacement or a refund.
6.7. La Cave du Château reserves the right to cancel or refuse any Order for legitimate reasons, such as supply issues, anomalies, quota breaches, or previous disputes.
Article 7 – Final Validation
Order confirmation constitutes proof of the Customer’s firm and final commitment and acceptance of these TCS.
Article 8 – Payment
8.1. Payments are secure and accepted by credit card, bank transfer, PayPal, or local solutions. La Cave du Château uses the Mollie service provider.
8.2. According to French Monetary and Financial Code, payment by card is irrevocable. The Customer guarantees they are the cardholder.
8.3. Orders are confirmed only after full payment has been received. Products remain the property of La Cave du Château until payment is completed.
Article 9 – Delivery
9.1. Orders are shipped after full payment.
9.2. Average delivery times are six (6) working days, excluding exceptional circumstances.
9.3. Delivery is available in countries listed on the Website, subject to local legal restrictions. For other destinations, the Customer must contact La Cave du Château.
9.4. Orders are delivered to the address provided. Any errors in the address are the Customer’s responsibility.
9.5. Delivery times are indicative. Delays do not give rise to compensation.
9.6. The Customer can track their Order online and receives a tracking number upon shipment.
9.7. In case of delay exceeding seven (7) working days, the Customer may request cancellation and refund.
9.8. The Customer must check the condition of the Products upon delivery, issue reservations on the delivery slip, and report any anomaly within three (3) days.
Article 10 – Right of Withdrawal
In accordance with the law, the consumer Customer has fourteen (14) days from receipt of the Products to exercise their right of withdrawal. Return costs are borne by the Customer. Refunds are made within fourteen (14) days of receipt of the returned Products in perfect condition.
Article 11 – Warranties
Products benefit from the legal warranties of conformity and against hidden defects as provided by the French Civil Code. Any claim must be made within thirty (30) days from delivery. Return costs are reimbursed upon proof.
Article 12 – Liability
La Cave du Château cannot be held liable in case of non-compliance with the laws of the country of delivery, improper use of the Product, or risks inherent to the Internet (interruption, hacking, viruses, etc.).
Article 13 – Intellectual Property
The Website and all its elements (texts, images, databases, trademarks, domain names) are protected by intellectual property rights and belong to La Cave du Château or its partners. Any unauthorized use is strictly prohibited.
Article 14 – Personal Data
14.1. Browsing the Website may require cookies. Users can configure their preferences.
14.2. La Cave du Château collects and processes Customers’ personal data to manage Orders and operate the Website. Data is secured and retained for the necessary duration.
14.3. The Customer has the right to access, rectify, oppose, and delete their data by writing to La Cave du Château (31 avenue Franklin D. Roosevelt, 75008 Paris).
14.4. Data will not be shared with third parties without prior consent, except as required by law.
14.5. The Data Protection Officer is Mr. Damien de Gironde (contact@lacaveduchateau.com).
14.6. The Customer may freely subscribe to or unsubscribe from the newsletter.
Article 15 – Archiving
Order forms and invoices are archived on a reliable medium as proof of transactions between the parties.
Article 16 – Force Majeure
In the event of force majeure (an unforeseeable, irresistible external event), the performance of obligations may be suspended. If the suspension exceeds thirty (30) days, the Customer may cancel the Order and obtain a refund.
Article 17 – Protection of Minors and Health Warning
The sale of alcohol is prohibited to minors under 18. The Customer certifies being at least 18 years old when placing the Order.
Alcohol consumption is discouraged for pregnant women.
